1. Introduction
This website, https://buildstackpro.com, including its sub-domain https://app.buildstackpro.com and related services (collectively, the “Site”), is owned and operated by BuildStackPro (“Company,” “we,” “us,” or “our”).
By accessing or using the Site, creating an account, or subscribing to our services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Site.
2. Effective Date
These Terms are effective as of February 26, 2026.
3. Age Requirements
You must be at least 18 years old to use the Site. If you are between 13–17 years old, you may only use the Site with parental or guardian consent. No part of the Site is directed to children under 13.
4. Account Sign-Up
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
5. Subscription Terms
5.1 Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles payment processing, tax collection, and billing-related customer inquiries. By making a purchase, you also agree to Paddle’s Checkout Terms.
5.2 Recurring Billing
Subscriptions renew automatically unless canceled before renewal. Renewal charges will be at the then-current non-promotional rate.
5.3 Cancellation
You may cancel anytime via your account dashboard or Paddle support. Cancellation prevents future charges but does not refund past payments unless explicitly covered under Section 5.4.
5.4 Refunds
- EU/UK Right of Withdrawal: Residents of the European Union or United Kingdom may request a refund within 14 days of their initial purchase, provided the service has not been substantially used.
- Technical Failures: If the platform fails to deliver the subscribed service due to verified technical issues, you may request a refund. Refunds for such failures are granted at the sole discretion of the Company.
- General Policy: Except as required by law or outlined above, subscription fees are non-refundable.
5.5 Currency
Fees are charged in U.S. Dollars unless otherwise stated. Paddle may apply currency conversion or local taxes depending on your location.
6. API Credentials (BYOK Model)
BuildStackPro operates on a Bring Your Own Key (BYOK) model for AI services (e.g., OpenAI, Anthropic, Replicate).
- You are responsible for obtaining and maintaining your own API keys.
- All costs incurred with third-party providers are your responsibility.
- Keys are encrypted at rest and used only to process your requests.
- We are not liable for service interruptions, usage limits, or costs from third-party providers.
- You must comply with the terms of service of each API provider you use.
7. Cloud Deployment Services
We provide automation tools to deploy websites to cloud platforms (AWS, Google Cloud, Azure, GitHub).
- You must maintain your own accounts with cloud providers.
- Costs incurred on your cloud accounts are your responsibility.
- If you cancel your subscription, your deployed sites remain on your cloud infrastructure.
- We are not responsible for outages, downtime, or security incidents on third-party cloud platforms.
8. AI-Generated Content
- Ownership: You retain ownership of websites and content generated through the platform.
- Disclaimer: AI-generated content may contain errors, inaccuracies, or inappropriate material. You are responsible for reviewing and ensuring compliance with laws and third-party rights.
- No Guarantee: We do not guarantee uniqueness, accuracy, or copyrightability of AI-generated content.
- Compliance: You must ensure generated content does not violate intellectual property, privacy, or regulatory laws in your jurisdiction.
9. Representations and Warranties
- You are at least 13 years old (with parental consent if under 18).
- Your use of the Site is lawful in your jurisdiction.
- You will not use the Site for illegal, obscene, discriminatory, or harmful purposes.
- You will not interfere with or damage the Site.
- You will comply with all applicable export control and data protection laws.
10. Site Disclaimer
The Site is provided “as is” and “with all faults.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, BuildStackPro shall not be liable for indirect, incidental, or consequential damages. Our total aggregate liability shall not exceed USD $100 or the amount paid by you in the six (6) months preceding the claim, whichever is greater.
12. Governing Law & International Use
These Terms are governed by the laws of Bangladesh. Disputes shall be resolved exclusively in the courts of Dhaka, Bangladesh. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
For international users, local consumer protection laws may also apply.
13. Termination
We may suspend or terminate your account immediately for violations of these Terms, fraudulent activity, or harmful conduct. Upon termination, your right to use the platform ceases immediately. You remain responsible for any outstanding fees or obligations.
14. Prohibited Conduct
- Spam or search engine manipulation.
- Malware, phishing, or illegal content.
- Reverse-engineering our infrastructure.
- Infringing intellectual property rights.
- Attempting to bypass security or usage limits.
